Terms & Conditions
These terms set out how we work with you and what to expect when you engage Delta Gates Pty Ltd (ABN 47 681 294 503) for design, fabrication, installation or repair of gates, automation or matched frontage fencing. By submitting a quote enquiry or accepting a quote, you agree to these terms.
1. Who we are
“Delta Gates”, “we” and “us” means Delta Gates Pty Ltd, a Victorian company based in Carrum Downs. “You” means the person or entity engaging us to carry out work. Reuben Mackenzie is the owner-operator and your point of contact.
2. Quotes and ballparks
- Ballpark estimates given over text, phone or email are indicative only. They are based on what you tell us and are not a fixed price.
- Written quotes issued after a site measure are valid for 30 days unless we agree otherwise in writing. Prices may change after that period due to material costs or schedule availability.
- Quotes are based on the scope, materials and access conditions described in the quote. Anything outside that scope is treated as a variation (see clause 7).
3. Accepting a quote
You accept a quote by signing it (electronically or in person), confirming acceptance in writing, or paying the deposit. Once accepted, the quoted scope, price and timeframe form our agreement with you.
4. Deposits and payment
- A deposit is payable on acceptance. The amount is shown on your quote and is typically used to order materials.
- Progress payments may be required for larger jobs and will be set out in the quote.
- The final balance is due on completion of the work, before final handover, unless we have agreed otherwise in writing.
- We accept bank transfer. Other methods may attract a surcharge.
- Overdue invoices may attract interest at the rate of 8% per annum, calculated daily.
5. Your responsibilities
To help us deliver the work efficiently, you agree to:
- Provide safe, reasonable access to the site on agreed dates.
- Hold any necessary owners-corporation, council or neighbour approvals where the work requires them.
- Disclose any underground services, easements or restrictions on the property that we should know about before work begins.
- Provide a power supply for tools on site where reasonably needed.
- Make decisions on materials, finishes and design within a reasonable timeframe so we can keep the job on schedule.
6. Materials and finishes
We source materials to match the specifications in your quote. Slight variation in colour, grain or texture is normal in steel, timber and powder-coat finishes and is not a defect. If a specified material becomes unavailable, we will let you know and suggest an equivalent before substituting.
7. Variations
Anything outside the scope of the accepted quote is a variation. We will price it, get your approval in writing (text or email is fine), and add it to the final invoice. We will not start a variation without your sign-off.
8. Timing and delays
We provide an indicative install window in your quote. Actual timing depends on weather, supplier lead times, council inspections and site access. We will keep you posted if anything is going to slip. We are not liable for losses caused by delays outside our reasonable control.
9. Workmanship warranty
We warrant our workmanship for five (5) years from the date of installation. This covers structural defects in the work we performed and is provided to the original customer at the installation address; it is not transferable on sale of the property. The warranty does not cover:
- Wear and tear, weathering or fading of finishes consistent with the material.
- Damage caused by accident, misuse, vehicle impact, severe weather or unauthorised modifications.
- Failure of automation components, which carry their own manufacturer warranty (passed through to you on installation).
- Work carried out by others on or to our installation.
Nothing in this clause limits any non-excludable rights you have under the Australian Consumer Law.
10. Liability
To the extent permitted by law, our liability under or in connection with the work is limited, at our option, to repairing or replacing the defective work, or refunding the amount paid for it. We are not liable for indirect or consequential losses (such as loss of profit or business interruption). We hold current public liability insurance appropriate to the scale of our work and can provide a certificate of currency on request.
11. Cancellation
- You may cancel before we order materials by giving us written notice. Any deposit paid will be refunded less reasonable costs incurred.
- Once materials are ordered or fabrication has started, the deposit is non-refundable and you may be liable for the cost of materials and labour committed to the job.
- We may cancel if site conditions, safety risks or non-payment make the work impractical to deliver. In that case we will refund any portion of payments not yet earned.
12. Photos of the work
We may take photographs of completed installations for our portfolio, website and social media. We take reasonable care not to publish identifying details such as street numbers, vehicle registrations or residents in those photos. Tell us before installation if you would prefer your job not to be photographed.

14. Governing law
These terms are governed by the laws of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
